Navigation : About éThis charter was written in order to set the general user conditions of the Cromimi game, an internet site run by Beemoov SARL.
It was written in order to enable a good running of the site and to prevent any form of misuse.
It mainly defines what everyone can and can't do on this site.
Registering with cromimi.com implies the global and total acceptance of this charter.
» Beemoov.com: the name of the community site edited by the Beemoov company. This is a game where there is no obligation to buy anything but options to make the game actions easier can be purchased.
» Paying service(s): all services available to Members with specified prices when reading the page of introduction can be pruchased on the "bank" page. PayPal is a service for payments by credit card. Ticket Surf International is a service of prepaid cards. Allopass is defined as an audiotel and SMS service provider.
» Host: the partner in charge of maintenance and data hosting. (OVH SAS)
» Member(s): all users who are registered to beemoov.com.
» Account: all the informations about a Member. They can be accessed with an identifier (or user name) and a secret code.
ARTICLE 1 - REGISTRATION
Every person who registers to cromimi.com becomes a member of the cromimi.com site. The informations provided in the registration form on the registration page must be true.
The administrator has the right to refuse registrations from people whose informations sound inaccurate or false.
Members must keep their informations up to date so that they remain true.
Each Member receives an account defined by an identifier (also called user name) and a secret code which enable them to access the site later. The identifier and the secret code are chosen by the Member according to the limitations fixed by the administrator.
Members must keep their secret code confidential in order to prevent an outsider to access cromimi.com with their identifier.
It is strictly forbidden to give or lend an account.
The editor is not responsible for the damage caused on an account if it has been used by an outsider.
Registration to cromimi.com is limited to one per physical person. If the editor happened to learn about the existence of a second account for the same person, the latter would lose all the accounts and all the data linked to them. This means the loss of all the things owned by the Member on the site (money, items, trophies, etc.)
People under 18 can only register after receiving their parents? consent. Cromimi.com is suitable for children and adults so it is important to keep in mind that using cromimi.com and the services offered by cromimi.com must be watched by parents or legal tutors. So it is the parents? responsability to determine if a service is appropriate or not for their children and to keep an eye on them.
ARTICLE 2 ? EXCHANGES BETWEEN USERS
The cromimi.com site includes several spaces of exchange between users, a forum in particular. As registered users, Members can access theses spaces, totally or partially.
To make sure that exchanges are made in good conditions, Members must respect the principles related to the use of discussion systems and ban any element relevant to the deontological recommandations of the Superior Council of Telematics which are:
- » conflicting with public order and good morals
- » insults, libel, racism, xenophobia, homophobia, revisionism or damaging other people?s honour or reputation
- » encouraging discrimination, hatred of a person or a group of persons because of their origin, sexual orientation, because they belong or don?t belong to a specific ethnic group, nation, race or religion
- » threatening a person or a group of persons
- » zoophilia or paedophilia
- » urology or scatology and any element which might be degrading or damaging to human people and their integrity
- » encouraging to commit an offence, a crime or a terrorist act or praising war crimes or crimes against humanity
- » encouraging to commit suicide
- » allowing third parties to access directly or indirectly hacked softwares, software serial numbers, softwares leading to piracy and intrusion in computers and telecommunication systems, viruses and logic bombs and generally speaking, any software or others
- » allowing to damage other people?s rights as well as the safety of people and goods
- » violating privacy of corresponding
- » confidential in spite of legislative measures or legal act related to computers, files and freedoms ( intern, privileged informations, constituent of insider trading or related to professional secrecy)
Any conversation between a Member and a third party is placed under the responsability of this Member and this third party. Members are responsible for all the comments made in their spaces. The editor and the host decline any responsibility about comments made between Members, given the technical aspect of their service.
To make sure that exchanges are made in good conditions, the editor has the right to reduce or stop any access to these spaces of exchange. The latter, which can be accessed on the Cromimi site by any member without any secret code or particular invitation, are considered as public (there are notably public forums). The editor can access any data coming from public exchange spaces and these data can be saved.
Spaces which can only be accessed after being invited by another member or entering a secret code, and the data which have been personally received are considered as private. The editor doesn?t save any data coming from a private exchange space except those that are necessary for the space to work properly, except the data that have been provided by a Member who can access this space. By sending data on public exchange spaces of the cromimi.com site, Members allow the editor to spread these data on any data carrier. The editor can not be held responsible by a Member for sending data which don?t belong to the latter.
ARTICLE 3 - ACCESS SERVICES
The editor can?t guarantee the quality and continuity of the services offered to Members. The editor can end or change the characteristics of the services any time and without notice. The editor can also stop, temporarily or definitively, the access to the whole or part of the site, notably for technical reasons and without notice. Members undertake not to try to use the services in another way than the one decided by the editor. In particular, Members undertake not to try to damage the system or insert viruses or systems that enable to artificially change some informations. The editor has the right to use a legal court in case of damage caused to the integrity of the system. (About this : Art. 323-1 of the penal code)
ARTICLE 4 - PRICE AND PAYMENT TERMS
Members can obtain bonuses through different methods of payment present in the bonus page. They can also obtain these bonuses through other ways revealed in the site such as sponsoring (will come soon) or bonus donation by the editor.
Once acquired, these bonuses are indefinitely valid on the site. Nevertheless, the editor has the right to suspend the access to an account (cf. ARTICLE 6), in this case, bonuses will be lost.
Indicated prices are inclusive of all taxes.
ARTICLE 5 ? EXTRA SERVICES AND HONORARY TITLES
In some cases, the Member can receive different extra services or honorary titles valid on the site. The provided informations about the ways to receive these services and titles does not imply any obligation from the editor. Generally speaking, the editor has the right to allocate or delete these extras. Deleting an extra that has already been obtained doesn?t imply any compensation.
ARTICLE 6 - ACCOUNT CLOSURE
The editor has the right to close the account of one or several Members without notice or explanation. The editor has notably the right to close the account of a Member if the latter has not respected this charter.
A Member can delete their account on their own initiative through the site interface.
Some of the data associated to the Member (notably the messages that have been sent) may be kept in order to ensure the continuity of the site. Other data may be kept by the editor for technical archiving purposes. In case of an infrequent use of an account, the editor has the right to delete certain data or even close the account.
In case of an account closure, the editor will not pay off or indemnify the Member for the bonuses that might still be available on their account or for any payment made by the Member. Besides, no financial compensation will be given to the Member by the editor.
ARTICLE 7 ? MODIFICATION OF THE CHARTER
The editor has the right to modify the charter in order to adapt it to the evolutions of the site and/or its use. It is the Member?s duty to keep informed about the modifications brought to the use charter.
ARTICLE 8 ? PERSONAL INFORMATIONS
In application of the law n° 78-17 of January, 6 1978 related to computers, files and freedoms, you have the right of veto (art. 26 of the law), access (art. 34 to 38 of the law) and correction (art. 36 de la loi) of your personal data. The editor has signed in for an automated processing of personal informations to the National Commission for Computers and Freedoms. As a result, any Member has the right to demand that any personal informations that might be false, incomplete, ambiguous or out-of-date get changed, completed, clarified, updated or erased. The request must be sent, in writing, with the sender?s name and address to the address of the company of the editor which is indicated on the header of this use charter.
ARTICLE 9 ? COLLECTING IP ADDRESSES
The editor can keep and use Members?IP addresses for a later identification if requested by a judicial authority, the police or any law-authority. Besides, the editor can give the IP address of the Member to the service provider(s) in case of a non respect of this charter for identification and possible expulsion purposes.
ARTICLE 10 - PROPERTY
The editor is the sole owner of the softwares, games, web pages, scripts and graphic content present on www.cromimi.com. Members must take them as work for the spirit and so refrain from copying, reproducing, translating in any other language, adaptating, distributing them for free or paying, or, for the games, softwares and scripts, assigning them any object that may not comply to their specifications. They are part of the secrets of the making and confidential informations without any regard for the fact that these elements may be protected or not by the current legislation for an intellectual property right.
ARTICLE 11 - RESPONSABILITY
Given the characteristics and limitations of the Internet ? which the Member must know ? the editor cannot be held responsible for the response times to view, query or transfer informations, for the interruption risks, and more generally speaking, for the risks related to any connection and transmission on the Internet, for the absence of protection of certain data against possible misappropriation and possible contaminations by computer viruses running on the network.
As a result, the editor cannot be held responsible without this list being restrictive:
- » transmission and/or reception of any data and/or information on the Internet.
- » any malfunctioning of the Internet network preventing one or several services offered on cromimi.com to run smoothly and/or work.
- » fault of any reception hardware or communication lines.
- » any paper or electronic mail loss and, more generally speaking, any data loss.
- » transmission problems.
- » any software working.
- » consequences of any virus or computer bug, anomaly or technical failure.
- » any damage caused by a Member?s computer.
- » any kind of technical, hardware or software failure, preventing or limiting the use of one of the offered services on cromimi.com or damaging the computer system of a Member.
Using cromimi.com services is placed under the full responsability of the Member. It it the Member?s duty to take all fitting measures to protect from any damage their own data and/or softwares present on their computer.
Besides, the use of cromimi.com and of the services offered on the site can be momentarily interrupted for maintenance, updates or technical enhancements, or to make content and/or presentation evolve. The editor will, beforehand and as far as possible, let the Members know about a maintenance or update operation. Members will not hold the editor responsible for the functionning and use of the services.
ARTICLE 12 ? INTERNATIONAL USERS
Given that cromimi.com can be accessed on the Internet network by users from any country, Members must respect all the laws of the country where they use the site and where they send data from.
The applicable right is the French right. The court of competent jurisdiction is the trade court of Nantes (France).
ARTICLE 13 - INDEMNIFICATION
Members undertake to guarantee and indemnify the editor, their representatives, their salaried employees, their partners for any damage, complaint or request coming from a third party after sending, displaying, downloading, broadcasting or transmitting data about the site, how to use it, the violation of the General User Conditions, or other people rights or public order. This guarantee covers all indemnities which might be paid as well as lawyer and legal fees in a reasonable limit.
